ENTIRE AGREEMENT:
This agreement contains the entire understanding between Laura Miller Photography and the Bride and Groom. It replaces any prior agreements that may have been made.
CONFIRMATION:
A signed wedding contract and a 20% booking fee are necessary to confirm the stated wedding services from Laura Miller Photography.
PRE-WEDDING CONSULTATION:
The Bride and Groom will outline in detail their specific requirements and Laura Miller Photography will advise on planning, logistics and timings where needed. The Bride and Groom may request an additional consultation closer to the wedding in order to confirm remaining details. Laura Miller Photography will contact you by telephone in the week before the wedding to ensure that there have been no last-minute changes.
COOPERATION:
The Bride and Groom and Laura Miller Photography consent to cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. We recommend that the wedding photographer be provided with a helper (usually the best man) who will assist in the organising of the formal photographs. The Bride and Groom also agree to give the photographer sufficient warning of key events at the wedding to give the photographer time to prepare e.g., bout throwing, cutting of the cake, speeches etc. Please note that not all wedding guests like having their photo taken, in such cases the wedding photographer will use their discretion but cannot be held responsible for a lack of photographs of these people and as a wedding is a dynamic event no particular shot is guaranteed.
THE SCHEDULE:
The shooting schedule, style of working and experience are designed to achieve a set of wedding photographs for the Bride and Groom to enjoy for years to come, accomplished with good humor and enjoyed by all concerned. The Bride and Groom and Laura Miller Photography therefore agree that punctuality and cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness of the Bride) Laura Miller Photographycannot guarantee to take the complete set of photographs, but in such circumstances will do the absolute best to compensate. The Bride and Groom agree to provide refreshments and a meal for the photographer/s should the length of attendance exceed six hours.
PHOTOGRAPHER TIME AND WORKING HOURS: Laura Miller Photography time and working hours are agreed in each Wedding package and will begin at the time of arriving, and concludes when leaving the Wedding venue. Any additional time required by the bride and groom over and above the agreed wedding package, will be agreed within the timetable section of this contract or at the earliest convenience on the day of the wedding. Laura Miller Photography cannot guarantee that additional time will be available, but accepts that some flexibility may be required. Any additional time will be charged at the rate of £80 per hour, pro rata part of.
PAPARAZZI WEDDING GUESTS:
The majority of your guests will have digital cameras and phones, and those guests will want to photograph the Bride and Groom. In the spirit of cooperation, the Bride and Groom agree to give the photographer precedence in order to take the photographs required for the wedding services. We cannot be held liable for a lack of wedding photographs if the photographer’s work is interrupted. We would further request the Bride and Groom’s assistance in ensuring that we have time alone when taking those special romantic shots.
HOUSE RULES:
The photographer is sometimes limited by rules imposed by registers ministers and venue management as to what can and can’t be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location, in such circumstances the Bride and Groom agree to accept the technical limitations that may be imposed. Laura Miller Photography will liaise with the venue concerned to understand the requirements and negotiate if necessary.
Laura Miller Photography will not tolerate verbal or physical abusive behavior, nor will they share or compete with guest photographers for the attention of their subjects. If the Bride and Groom are unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer, it will result in the early or immediate departure of the photographer. The Bride and Groom understands that in such an event no refund will be granted.
COPYRIGHT LAW:
English Copyright Law states that the copy right of photographs remains with the photographer. A license of your wedding photographs is given to the Bride and Groom upon full payment under the following conditions; The digital images taken by Laura Miller Photography are for personal use by the Bride and Groom and their friends and family, if any party wishes to sell the wedding photographs for profit, permission must be sought from Laura Miller Photography.
MODEL RELEASE:
The Bride and Groom grant Laura Miller Photography and its legal representatives the irrevocable and unlimited consent to use the photographs of the Bride and Groom for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. Any requests not to publish or use photographs for promotional material will be sensitively considered.
LIMIT OF LIABILITY:
If the photographer is too ill or becomes injured and cannot supply the wedding services, Laura Miller Photography will do everything possible to book a replacement wedding photographer. If a replacement photographer cannot be found in these circumstances, liability is limited to a full refund of any monies received. Laura Miller Photography has working methods in place to prevent the loss or damage of your images, however in the highly unlikely event that the images be lost, stolen or destroyed for reasons beyond the control of Laura Miller Photography, in these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of original images supplied.
CANCELLATION:
If the Laura Miller Photography has to cancel this contract for reasons beyond their control, for example including but not limited to Death, Injury or Sickness, The Photographers liability shall be limited to a full refund of all monies paid including the booking fee.
Where the Photographer is forced to cancel this contract, The Photographer shall make all efforts to find a replacement Photographer of equivalent professional standing and negotiate a similar package on a best effort basis. No guarantee of a replacement can be made, but where a replacement can be found, The Client will enter into a new agreement with the replacement photographer.
The Clients may reschedule the Wedding, but The Photographer cannot guarantee that the new event date will be available.
The Clients may cancel the contract at any time, subject to the following charges:
From the date, the contract is signed to within nine months of the Wedding date, The Clients liability is limited to the initial booking fee only.
1 Within less than nine months, but more than six months of the Wedding date, The Clients liability is limited to 50% of the total package price.
2 Within less than six months, but more than three months of the Wedding date, The Clients liability is limited to 75% of the total package price.
3 When cancelling within one months of the Wedding date, The Clients liability is limited to 85% of the total package price.
The Photographer would highly recommend The Clients taking out wedding insurance which would cover all fees should the wedding be cancelled.
FINAL IMAGES:
Laura Miller Photography will present you with all images taken at your wedding which meet our quality standards. We are the sole and final judge of those standards and any images which fail to meet with those standards are permanently discarded.
VIEWING AND PROOFING:
Photographs are normally ready for viewing at the proofing stage between 42-56 days after the event. The Bride and Groom will be able to view these photographs in their own online gallery. A maximum of two edits will be included. Any extra edits will be charged at the hourly rate of £80.
ONLINE SERVER:
The photographer will be kept on the online server for a maximum of 12 months and it is the responsibility of the Bride and Groom to ensure the safe keeping and back up of the photographs, once they have been presented.
RIGHT TO CANCEL
Please note the consumers’ right to cancel all contract with 14 days providing that no clearly personalised work or order has already been undertaken by Laura Miller Photography on behalf of the client.
NOTE:
For wedding album orders, the photograph selection must be agreed and submitted within six months of the ceremony if included in the package.
